You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day
- on which you or a third party named by you, other than the carrier, took possession of the goods, provided that you ordered one or more goods as part of a single order and these are delivered together;
- on which you or a third party named by you, other than the carrier, took possession of the last goods, provided that you ordered several goods as part of a single order and these are delivered separately;
- on which you or a third party named by you, other than the carrier, took possession of the last partial shipment or the last item, provided that you ordered goods that are delivered in several partial shipments or items;
To exercise your right of withdrawal, you must inform us (Butch GmbH, Bahnhofstr. 6, 95195 Röslau, Telephone no.: +49 9238 9909790, E-mail address: [email protected]) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, although this is not mandatory.
You may also exercise your right of withdrawal online via a correspondingly labelled button ("Withdraw from contract" or a similar designation) on our website (www.butch.de). If you use this online function, we will send you confirmation of receipt without delay on a durable medium (e.g. by e-mail), including information on the content of the withdrawal declaration as well as the date and time of its receipt.
You may also fill in and submit the model withdrawal form or any other clear statement electronically on our website (www.butch.de). If you make use of this option, we will send you a confirmation of receipt of such a withdrawal without delay (e.g. by e-mail).
To comply with the withdrawal period, it is sufficient that you send your notification concerning the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse you for all payments we have received from you, including delivery costs (with the exception of the additional costs arising from your choice of a type of delivery other than the lowest-cost standard delivery offered by us), without delay and at the latest within 14 days from the day on which we received notification of your withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; under no circumstances will you be charged any fees as a result of this reimbursement.
We may withhold reimbursement until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.
You must return or hand over the goods to us without delay and in any case at the latest within 14 days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the period of 14 days has expired.
You bear the direct costs of returning the goods.
You only have to pay for any diminished value of the goods if this diminished value is due to handling of the goods that is not necessary to check their nature, characteristics and functioning.
Grounds for exclusion or expiry
The right of withdrawal does not exist for contracts
- for the supply of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive, or that are clearly tailored to the consumer's personal needs;
- for the supply of goods that can spoil quickly or whose expiry date would be quickly exceeded;
- for the supply of alcoholic beverages whose price was agreed at the time the contract was concluded, but which can be delivered no earlier than 30 days after the conclusion of the contract and whose current value depends on fluctuations in the market over which the trader has no influence;
- for the supply of newspapers, periodicals or magazines, with the exception of subscription contracts.
The right of withdrawal expires prematurely for contracts
- for the supply of sealed goods that are not suitable for return for reasons of health protection or hygiene, if their seal was removed after delivery;
- for the supply of goods that, after delivery, were inseparably mixed with other items due to their nature;
- for the supply of audio or video recordings or computer software in a sealed package, if the seal was removed after delivery.
